The Other View

The “independent Supreme Court” has done a lot in the last decade which hurts the Elected Executive. The highest court has chased the black money issue with some clear direct judgments  on the kid glove handling of the important issue. Both  the present NDA government led by the BJP and  the previous government led by the Congress Party have felt discomfited over Supreme Court rulings and directions in many cases of corruption and black money.

The 2G scam, Commonwealth Games scam, the Coal block allocation scam etc. might not have seen the light of the day if Politicians had the  remote role  over the appointment of Judges. Let us be honest, we have not seen a responsible government for a long time.

Conclusion

Electoral Oxymoron in the name of Democracy: there is a serious trust deficit between Judiciary, elected, executive and the citizens of India.

The change of government or the fact that this government has clear majority has done little for the Citizens of India.

• Judicial appointments must have independence and be an integral part of judicial justice.
• Judicial primacy should be followed in judicial appointments with executive participation.
• The NJAC violates the rule of judicial primacy through its veto  by  two members mechanism.

Never before did India need  more than now an independent judiciary when the nation is sought to be plundered by  a growing number of the greedy and those in power  and is at the brink of breaking up because of the divisive policies being pursued by  all shades of political parties, with the ruling party at the center leading the pack. More than ever before, the poor and the unprivileged need the protection of an independent judiciary when politicians and the powerful moneyed lobby together are working against their interests. Left unbridled, executive and legislature can create havoc  for the country and its 1.21 billion people. In fact, the whole  nation needs an independent judiciary to guard it.
